Terms of Service
1. What the service is
Verity Train is a software platform that delivers state-mandated workplace harassment-prevention training, records completions, issues certificates carrying statute citations and verification IDs, and maintains an exportable audit log. Verity Train is a recordkeeping and delivery tool.
2. What the service is not
Verity Train is not a law firm and provides no legal advice. Content follows each state's published model-training requirements, but the employer remains solely responsible for compliance with all applicable laws, including scheduling, covering all required workers, and satisfying any jurisdiction-specific obligations. State requirements change; final legal responsibility for timely, correct training rests with you, the employer.
3. Employer obligations
- Enter employee roster data accurately (employee names appear on certificates as entered).
- Assign training to all covered workers on the schedule your state requires (e.g., California: within 6 months of hire; New York: annually; Illinois: annually).
- Designate which staff are "supervisors" correctly, so they receive the correct (California: 2-hour) course.
- Retain certificates and audit exports per your state's retention window (CA: minimum 2 years).
4. Billing
Service is billed per employee per year. Access to certificate issuance requires an active subscription; audit-log exports remain available for the statutory retention period even after cancellation, so your obligation to keep proof is never interrupted.
5. Content accuracy and changes in law
Course content is maintained against published state model curricula (NY Labor Law §201-g; IL Human Rights Act 775 ILCS 5/2-109; CA Gov. Code §12950.1). If a state materially revises its model, we update the affected course and notify account administrators. Employers should periodically confirm that their use of the training continues to satisfy their obligations, particularly in regulated industries (e.g., NYC Stop Sexual Harassment Act annual notice requirements).
6. Acceptable use
No scraping, no reselling without written partner agreement, no uploading of protected health information, no submission of roster data to which you have no rights. Fraudulent account use (fake completions) voids the compliance value of the audit log and terminates the account.
7. Data and privacy
Employee data handling is governed by the Privacy Policy. You represent that you have authority to submit your employees' names and email addresses for training delivery.
8. Liability
To the maximum extent permitted by law: the service is provided "as is"; our total aggregate liability for any claim arising from the service is capped at the fees you paid in the twelve months preceding the claim. We are not liable for penalties, state fines, judgments, or settlement amounts arising from your underlying employment practices.
9. Termination
Either party may terminate at any time. Export tooling remains accessible for the statutory retention period following termination.
10. Governing law
These terms are governed by Indiana law; venue sits in Lake County, Indiana, unless a state consumer/statutory provision mandates otherwise for a covered employee dispute.
